Acceptance of Terms
By downloading, installing, or using the ScamCheck AI application ("App", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User", "you") and ScamCheck AI ("we", "us", "our"). Your continued use of the App following any changes to these Terms constitutes your acceptance of the revised Terms.
About ScamCheck AI
ScamCheck AI is an AI-powered scam detection application that helps users identify and report potentially fraudulent messages, links, QR codes, phone calls, and emails. The App is designed to serve users in the GCC region (UAE, Saudi Arabia, Qatar, Kuwait, Bahrain, Oman), India, Bangladesh, and the Philippines.
Eligibility
- You must be at least 13 years of age (or 18 years of age where the applicable local law sets that as the minimum) to use ScamCheck AI.
- By using the App, you represent and warrant that you meet the age requirements applicable in your jurisdiction.
- If you are under 18 and your jurisdiction permits use between 13–17, you should use the App only with the knowledge and consent of a parent or guardian.
- We reserve the right to restrict access if we have reason to believe a user does not meet eligibility requirements.
How the Service Works
ScamCheck AI provides two core functions:
4.1 AI Scam Scanning
You submit content (text messages, URLs, QR codes, phone numbers, or emails) to the App for analysis. Our AI engine returns a risk score. If the risk score is 70% or higher, the content may be stored anonymously to improve our community intelligence database.
4.2 Manual Scam Reporting
You may submit a manual report of a scam using the "Report a Scammer" or "Report Scam" features. Manually reported identifiers (phone numbers or email addresses) are only retained in our database if the same identifier is independently reported by multiple users. Single, uncorroborated reports are permanently discarded.
4.3 Scam Alerts
The App may display anonymised regional scam trend reports and alerts based on aggregated, anonymised intelligence data. These alerts are for awareness purposes and do not constitute individual risk assessments.
Acceptable Use
You agree to use ScamCheck AI only for lawful purposes and in accordance with these Terms. You must not:
- Submit content with the intent to falsely flag or maliciously report individuals, businesses, or organisations
- Use the App to harass, defame, or target any person or entity
- Submit personal data of third parties (such as private individuals' phone numbers or emails) for any purpose other than genuine scam reporting
- Attempt to reverse-engineer, decompile, or extract the App's source code or AI models
- Interfere with or disrupt the App's infrastructure, servers, or networks
- Use automated scripts, bots, or crawlers to interact with the App
- Attempt to manipulate the App's AI or intelligence database through coordinated or artificial submissions
- Use the App in any manner that violates applicable local, national, or international law
User-Submitted Content
When you submit content to ScamCheck AI for scanning or reporting, you acknowledge and agree that:
- You are submitting content that you genuinely believe to be, or suspect to be, scam-related
- You grant ScamCheck AI a non-exclusive, royalty-free, worldwide licence to store, process, and use submitted content for the purpose of scam detection, AI model training, and community protection
- Submitted content is anonymised — no personal identifiers linking the content to you are stored
- Content submitted below the 70% AI risk threshold is immediately discarded and never retained
- Manually reported identifiers are only retained where independently corroborated by multiple users
You must not submit content that you know to be legitimate (i.e., knowingly false reports) or that you have no reasonable basis to believe is scam-related.
AI Limitations & Accuracy
ScamCheck AI uses machine learning models to assess the likelihood that submitted content is a scam. You understand and accept that:
⚠️ False Positives
The AI may occasionally flag legitimate content as a potential scam. A high risk score does not definitively confirm that content is fraudulent.
⚠️ False Negatives
The AI may not detect all scams, particularly novel or sophisticated schemes it has not yet encountered.
📊 Probabilistic Output
Risk scores are probabilistic estimates, not certainties. The 70% threshold is a decision boundary, not an absolute guarantee of fraud.
🧠 Evolving Models
Our AI models are continuously improved. Performance characteristics may change over time as models are updated.
No Account / Anonymity
ScamCheck AI does not require you to create an account or provide any personally identifiable information. All features of the App are available anonymously.
Because the App operates without user accounts, we are unable to verify identities, recover access, or associate historical submissions with any individual user. This design is intentional to protect your privacy.
Privacy
Your use of ScamCheck AI is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you agree to the collection and use of information as described in the Privacy Policy.
In summary, ScamCheck AI collects no personal data about you as a user. The only data retained is anonymised scam content that meets our AI detection threshold (70%+) or has been independently corroborated through manual reporting by multiple users.
Intellectual Property
All intellectual property rights in the ScamCheck AI application, including but not limited to its source code, AI models, algorithms, user interface, design, branding, and content, are owned by or licensed to ScamCheck AI.
- You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial purposes in accordance with these Terms.
- You may not copy, modify, distribute, sell, sublicense, or create derivative works based on the App or any of its components.
- You may not use ScamCheck AI's name, logo, or branding without prior written consent.
Disclaimers
To the maximum extent permitted by applicable law:
- The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.
- We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.
- We do not warrant the accuracy, completeness, or reliability of any scam risk assessment or community alert provided through the App.
- We expressly disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, ScamCheck AI, its directors, employees, agents, and affiliates shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App
- Any loss of profits, revenue, data, goodwill, or other intangible losses
- Any financial or other losses resulting from acting on (or failing to act on) a scam risk assessment provided by the App
- Any damages resulting from unauthorised access to or alteration of your transmissions or data
- Any damages resulting from third-party conduct, including scammers or bad actors, encountered outside the App
Third-Party Services
The App may be distributed through the Apple App Store or Google Play Store. Your use of those platforms is governed by Apple's and Google's respective terms of service, which are separate from and in addition to these Terms.
The App may integrate with cloud infrastructure providers for data storage and processing. These providers are contractually bound by appropriate security and privacy standards and do not process your data for any purpose other than enabling the App's core functionality.
Termination
We reserve the right to suspend or restrict access to the App, at our sole discretion and without prior notice, if we believe you have violated these Terms or applicable law, or if required by law enforcement or regulatory authorities.
You may terminate your use of the App at any time by uninstalling it from your device. Upon uninstallation, no further data will be collected. However, anonymised scam content already stored in our intelligence database (meeting the applicable thresholds) may be retained in accordance with our Privacy Policy.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates (UAE), without regard to its conflict of law principles. Users in other jurisdictions may have additional rights under their local laws; nothing in these Terms is intended to exclude rights that cannot lawfully be waived.
15.1 Dispute Resolution
In the event of any dispute arising out of or in connection with these Terms or your use of the App, we encourage you to contact us first at support@scamcheck-ai.com so that we may seek to resolve the matter informally.
Where informal resolution is not achieved, disputes shall be referred to the competent courts of the UAE, or to the relevant courts of your jurisdiction where required by applicable mandatory consumer protection law.
15.2 Regional Regulatory Authorities
Users may also have the right to lodge complaints with their local data protection or consumer protection authority, including but not limited to:
- UAE: UAE Data Office (UAEDO)
- Saudi Arabia: Saudi Data & AI Authority (SDAIA)
- India: Data Protection Board of India
- Philippines: National Privacy Commission (NPC)
- Bahrain: Personal Data Protection Authority (PDPA)
- Oman: Information Technology Authority (ITA)
Changes to These Terms
We may update these Terms of Service periodically to reflect changes in the App, legal requirements, or our practices. When we make material changes, we will update the "Last Updated" date at the top of this page and notify users via an in-app notice on the next launch.
Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the App and uninstall it from your device.
